Data breaches are not new and have become more and more common over the last few years. So many companies worldwide have had illegal entries and access by unauthorised persons to the private data that they have collected about their customers. It is important that you have an understanding of the new mandatory data breach notification scheme (Privacy Amendment (Notifiable Data Breaches) Act 2016 (Cth)) that the Australian Government has passed on the 13th February 2017.
The mandatory data breach notification scheme applies to all bodies who are subject to the existing requirements under the Privacy Act and experience an ‘eligible data breach’. We encourage you to seek independent legal advice on how this may impact on your business including what you need to do to comply with these new requirements.
